Unemployment Extension July 21 2010 Update: Senate Passed HR 4213 Unemployment Extension Bill – Millions of unemployed Americans cheered as the Senate voted “yes” to pass the much awaited Unemployment Extension Bill. As previously mentioned, Carte Goodwin, the Senator who replaced the late Robert Byrd of West Virginia sworn in at 2:15 and voted “yes” at 2:30 adding to the total of 60-40 votes to counter the previous Republican filibuster.

Of all the Republicans who voted “no” and Democrats who voted “yes” for the Unemployment Extension Bill, one Democrat, Sen. Ben Nelson from Nebraska voted with Republicans against the motion, and two Republicans, Sen. Susan Collins and Sen. Olympia Snowe, both from Maine crossed the aisle to vote with the Democrats. Meanwhile, two Independents, Senators Joseph Lieberman from Connecticut and Bernie Sander from Vermont voted in favor of the Democrats to pass the bill. I guess these names would be remembered come elections this coming November.

Under Senate rules, a vote on passage of the unemployment bill itself must now occur within 30 hours. This is the “motion to concur in the House amendment to the Senate amendment to the bill with Reid Amendment No. 4425” of which unlike the original 60 votes needed, a simple majority of 51 “yes” votes is needed to pass. Since the Democrats have just shown that they have more than 51 votes for the bill in the first Senate vote, the Republicans probably may just agree to letting the final vote happen before the 30-hour clock has completely run out.

After this final Senate vote, this unemployment bill can now be send over to the House of Representatives for the final vote and finally lined up for Obama’s signature to become an official law. Once the bill becomes a law, it is expected that state labor departments will immediately begin implementing it and sending out unemployment benefits to help the millions of unemployed Americans. If our politicians would move as quickly as they can, this much awaited unemployment extension bill could become a law as early as Wednesday afternoon or the latest at the end of this week.

For the record, the unemployment extension bill passed by the Senate which is soon expected to become a law is called H.R. 4213. This is not the Tier 5 that most unemployed is clamoring as it would not create additional weeks of unemployment benefits. As in Tier 4, 99 weeks would still be the maximum amount of time an unemployed American could receive unemployment benefits for states with high unemployment rates (above 8.5%). However, as in Tier 3, 86 weeks would still be the maximum time for those who are located in states with low unemployment rates.

In addition, H.R. 4213, originally named as the “American Jobs and Closing Tax Loopholes Act” has now been renamed to as the “Unemployment Compensation Extension Act.” This bill would also extend the filing deadline for unemployment insurance benefits which expired last June 2 to until November 30, 2010. The bill also provides for unemployment benefits to be paid back retroactively for people who have seen their payments cut off since the filing deadline expired on June 2.

    It’s a damned shame that it took over 2 months for the party that relies on the middle class to make them richer to 1. block a bill that would stimulate an economy that will bring revenue to their party but 2. Looking like the enemy (screw the midleclass, the class that make us the richest nation on earth.)during a time of a recession. Remember the last democratic nation that disregarded the common man that we base our democracy on(GEECE then ROME)?. They are dead now! The healthier your common man is the stronger the country is. The 2 percent of rich individuals depend on us to keep them rich. Let’s use our power to change this fiasco before we become another dead nation.

Oh wait, that’s right, Congress takes August off, then there’s an election in November. Looks like it’s up to the Annointed One. Oh wait, he’ll be campaigning to save his partys’ majority in Congress. Looks like another fight for extended (and unpaid for) unemployment benefits again in December :-(

      Shamefully, my poor son had to quit technical school (TECHNICAL SCHOOL) after highschool. He’d dreamed of going t welding school but the shame of not even being able to carry a sandwich for lunch got to be too much for him. I’ll grieve his loss of his dream and I won’t forget what Congress did to my boy. I’ll be interested in how interested they become when He can’t pay back his FAFSA loans???

      Does anyone know if the retroactive benefits to June 3 will be paid as lump sums or spread out as additional payments over time to individuals? I haven’t seen anything address this. Its now 7 weeks beyond when the benefits stopped? Are we to assume that all 7 weeks will be made up in one lump some check after President signs this into law?

    the people getting shot down for a tier 5 did not get 86 weeks or 99…so how do we survive?

      You can get up to 99 weeks total. So with this bill passing which expires at the end of November, if you have more weeks coming to you in tier 4, you will get them but no more than 99 total. I will get 6 weeks. My tier 4 runs out on Saturday. Another bill will have to be voted on to extend the 99 weeks or add a tier 5. With all all of the unemployed and lack of jobs, this should be happening soon. Hopefully, not another 2 months!

      At least you got your 99 weeks. Those of use who only got 26 weeks of state UC are wondering why some citizens get 99 weeks while others only get 26. Especially since the unemployment rates are now double that of the rates in 2008. Congress doesn’t realize the inequity of the bills they pass. People are still getting laid off and no end in site. The unemployment rates only appear to improve only because people drop off the rolls, but that does not mean they have found jobs. I blame Congress’ interference in the “free” market economy that caused the current ecomonic crisis. You cannot “regulate” a free market into prosperity. Why hasn’t Congress learned this simple lesson?

    Of course it will wait until the election to vote on a 99′ers bill because by then all the people who benefit from the passing of HR4213 will be then 99 er’s. Don’t expect anything though. It will be another finger pointing political meltdown. Friends, grab your cup and soup dish and head out to the Salvation Army. THAT is the only place you will be getting a helping hand from that point on. Looks like Santa’s bag will only have coal in it this year (and a forclosure notice)

    I have a question does anyone know if the state extension is included in the new extension bill that passed on July 20.2010. because i still had weeks of benefits left when the deadline ended all benefits. i was on my 20 weeks of EB extension.

      it is included, the state extended benefits (SEB), and tiers 1-4 will get time extended :)

      From what I hear, YES We will recieve retroactively whatever we were cut off at. if you had 13 weeks left, you will recieve them. if you have been continuing to file you will recieve it all once approved.

      EU (additional 13 or 20 weeks (depending on the unemployment rate in that state, are) is supposed to kick in after all eligible tiers have been exhausted. However, the fed government was paying all of the EU benefits under the stimulus bill, ususally paid 50% by the state and 50% by the fed gov’t (as in NJ). Not all states have the same EU law, so when the federally funded extended benefits ran out, so did the final EU benefits in those states.

      someone please help me. I was on the one where u can only claim on line i dont kno wut the name is so confusing. Any way i finished tiers 1_ 4 and then started claiming on line cuz on that extension u can only claim on line. I still had a balance left will i b able to get the rest of my money i had left? I am so confused

      The illegal immigrants are hired ILLEGALLY because companies can pay them below minimum wage and they will work for it. As statistics have shown, there are 5-6 applicants for every job available today. That plainly says that there are more unemployed applicants than there are jobs. I was laid off 2 1/2 years ago and spend several hours a day, every day, looking for a job. I have sent out over 400 resumes as well as putting in as many applications. I was laid off because my job went to Honduras. I have 3 degrees. I am told either I am overqualified or underqualified or to those I have blindly sent resume’s to that they are not hiring due to the bad economy and that they too have had to lay off good employees as well. The majority of us are neither lazy nor foolish and we deserve assistance until there are more jobs available.

Without this assistance I would be in grave trouble. Republicans have many times passed unemployment extensions without paying for them up front. Typical hypocrite!

Either way I would be careful before throughing around the accusation that 10% of Americans are lazy because I would bet my last dollar that if they could find a job the majority of that 10% would take the job !@#hole!!!!!

      Hey dip$hit…the illegal immigrants already took the jobs away from those of us who could have used those jobs, and the H1 immigrants are hired preferentially because corporations get a tax break for doing that (ie the tax loophole they attempted to close on HR 4213 but the Republicans would let them).
      I have been working all my life, have a college degree, 20 years of job experience in my career field, and the only one who is foolish and lazy around here are idiots like you. You should try calling me foolish and lazy to my face sometime you little prick, not hiding behind some keyboard like the coward that you are.

    This bill is going to have to be amended i just hope they figure it all out before they ruin all of our lives. Im not even sure if i will get anything as far as retro is concerned ,if im a 99′er, im having trouble understanding this all! I do know my landlord is PO’ed who had been allowing me to pay weekly due to my weekly unemployment. If i was to even receieve back pay she would be gettin it all because of THE LATE FEES I’ve incured! Not to mention my court cost for fighting for a place to live for myself and children. A tier 5 needs to be added to make sure the AMERICAN PEOPLE can just have some peace of mind,a glimmer of hope while we fill out job app after job app answering the same questions over and over with no results!

    I’ve already exausted all my euc tiers, and am now on the extended benifit phase. I had about 2 months left on my remaining balance when I got cut off on June 12th, with this extension will I be paid retroactivly for all the weeks I faxed a file and didn’t get paid?

    Where in the world do they come up with the statement that there are only 8 applicants for every 1 job! This is ridiculous! I can tell you that companies have told me that out of over 300 resumes received for 1 admin job, only 6 were selected to interview. Another company told me that they had received over 800 resumes & only interviewed 10. I have been paying into the unemployment fund for apx 30 years & now when I need to claim the benefits, I have to suffer to receive them as a result from the Republican fillibusters! Honestly, I can’t believe it took Obama 2 months to finally come forth to speak on our behalf to press for the votes from the Senate to PASS our eligibility for benefits….AGAIN! This on-again & off-again circle of hardship is unbelievable! Thank you Obama, thank you Senate & thank you for not making me homeless!

    What is the senate voting on today. I am watching the Senate and they are voting again on extending unemployment benefits. I am confused I thought they voted on it yesterday Tuesday July 20th and it passed. So are the senators voting for a tier 5 today? Please let me know. Thank you.

      the house of representatives are voting today and if they pass it then it will go to the president. the senate voted to move it a long to get to the house.

      @ Adam….Yesterday Senate voted on cloture to even move forward with the bill. Now they have to have an “official” vote if you will (which at this time is being pushed aside by Republicans). By law this “vote” has to occur by 9pm tonight. It then will have to be revoted on by the House do to changes made by Senator Reid. Then it has to be sined by President Obama……my question is how long does it take after this for everyone to start receiving benefits???

      Simply put – on Tuesday they voted to break the fillibuster – it was a vote to allow for an official vote as the fillibuster kept them from even voting on it at all. Now it goes to the House and then to the President. From what I can find online a Tier 5 is not even in the works yet. For those of us who have maxed out our 99 weeks this bill does nothing for us.

      once it is signed by the president i heard it will be as quickly as people from unemployment can enter the weeks. bc there are so many that need to be enterd it might take a little while to get them all entered but they will be started right away once we (unemployemnt) get the official word to move forward.

    @ Carole…..No…it is still in Senate today. Yesterday was only a cloture vote to end filibuster. Today it’s actually taking a vote which only needs 51 “ayes”, then to the House for a vote, and then on to the President. (Hope this helps alleviate any confusion)

    FINALLY, some relief in sight for millions of displaced American workers that had no choice of becoming a severed employee from the company most American workers were 100% dedicated.

    It’s very sad that we work very hard all our lives to give our employers most of our time and energy sacrificing our families and most importantly of our selves to only expect a pay check in return.

    Once retired having very little to look forward due to the lack of savings since most of us in Americans had to suffer with losses in our 401k or had to liquidate the last resource of savings remaining to save our homes if possible.

    “Save the dream program” what a joke.

HOw much is okay to spend on secret gov operations, on call health care and large salaries for the gov?     Two Questions:

    1) Can someone please explain to me exactly what the November 30th expiration date of the bill means? I was 10 days into my first extension when they stopped all funds. I’ll only be in Tier 2 in Nov. when this bill expires. Does this mean they’ll cut off all extended benefits again in Nov. to re-assess the unemployment rates?

    AND

    2) I understand Tier 1-4 are part of H.R. 4213 and the 99ers are out of luck on this one, but what about the Fed Ed people? The last extension after Tier 4 but before you become a 99er….Do those people also receive retroactive pay?

    What a mess! Have to say my good people have come through in this MOST DIFFICULT time of need…. thanks for any input you can give…greatly appreciated!

    please help me clarify this in my head. When I got the the fifth tear extention, it said that I still had a balance of $3200, after the June 12th and final payment.
    So, do I get cut off from that balance, since it is my fifth extention., I thought any extentions previously approved would get completed with the new passing, and that the only change that was made, to get it sent through again, is that the extra $25.00 weekly stimulus is no longer included?

      I’m just as confused about that. I am in Tier IV, in Florida. In late May I was told I had $5500 in there, so I thought I was good until October. But then I was cut off in June, like everyone else. And Florida said all EB was cut off for everyone in June. So do I get those funds through the EUC? Because, the State won’t allow me EB? And is Florida really going to refuse the Federal EB money and let their citizens be the only ones not collecting on the EB portion?

    The easiest way to pass anything is to add tax breaks, or cuts for the super rich and the Republicans will join right in. Of course you could just as easily add around 450 Billion for the war machine and that will work too. I guess they are frightened that the 8 million, or so, out of work folks are going to stage a coup and run all of the heartless Republicans out of Washington. Hmmm??

    I am sixty eight years old and I lost my job in June 2008 after working in the same job for 28 years. I collect Social Security and I do not have a pension. Social Security has not been increased in two years,and we do not know if there will be a raise in 2011, we did not get the two hundred and fifty dollars in 2010 that we we received in the last year. I worked all life and I collected my unemployment for 99 weeks. I cannot get a job………….I am not lazy and I have worked hard all my life. Either the government must create jobs or it is their responsibility to take care of the American people………………………………………..

    When they say the 99rs are excluded by this bill, it leaves me with a question. The 99 weeks of benifets they speak of, does this include only the US Government paid extension or both State and Government. Also, Why are there so many illgals here bilking the welfare system that never worked here at least on record to avoid paying taxes, using multiple names so they can remain on the public dole. if the do take “one of the jobs no one else wants to do”, using a ficatous SS# in order to fool the already dysfunctional welfare system? This is what I get for working and paid taxes for almost 40 years?
    I just got kicked out of my apartment, with my belongings thrown all over the sidewalk by my landlord with the help of the sherrif because I couldn’t make rent. I sold what items I could while people walking and driving by just grabbed stuff without asking, I kept what I could fit in my two suitcases and am on my way for a long and sad walk to the animal shelter to give up my dog (My best friend) for adopton that I can’t afford to feed. Ironically, I adopted him almost 6 years ago from a shelter for Hurricane Katrina abandoned animals.
    Does anybody have about 8 feet of rope they can spare? I feel so down and hopeless. How can I go on? Why? :(

    I see that they passed the unemployment Extension but, the Senate is talking about Extending Long Term Unemployment, I am still confused so are they talking about making more Tiers? So even if the Senate passed the bill yesterday then what the hell is the Senate talking about at this hour?

      Carol answered my question. And what I know that it will take 7 to 10 days for the unemployed americans to get their money after President Obama signs the bill into law. If you are still filing even though you are not getting paid you will get a lump sum of the money you have left in your acct. Which is going to help alot of us out. Esp myself and my family. I am so tired of the republicans talking about the deficit. The unemployed and most of the employed really don’t care about the deficit.

    I ran out funds on my original unemployment claim the second week of June. I have never had an extension. I have continued to call in my weeks since then. Can anyone tell me if I will qualify for this extension? I called unemployment and they said they don’t have a clue until it is signed in to law.

    Can anyone out there relieve my stress. Will I be entitled to an extention?

    Also, my one year ends 7/31.

    My benefit year will soon expire then I will have to reaply I haven’t even received benefits for a year. Now I am so confused about this ordeal! I have not received an unemployment check in 1 month. Sunday I will have to do another EUC claim! Please hurry I am in need of the money! Will it come tomorrow?

    what is covered by the bill being passed? i got my unemployment started and went thru the 26 weeks plus tiers 1 thru 4 and exhausted all benifits.i was transferred into state extended benifits which was cut off in june. will you go ahead and be able to get those benifits as well?

    Hopefully they get this all done by the end of day. They also need to move along on getting a tier 5 extension passed!! I am unemployed,the company that I was employed for, decided to close are store and not place us older workers to another one of their stores. Fact was we made to much money to be transfered to another one of the companies locations. I have worked since I was 16 years old, and never collected a dime from any of the goverment run systems. I am near retirement age, but can’t collect that yet. I look for work every day and even have gone on numerous interviews. I am in the retail line of work and they are just not hiring.I am at my end of my tier 4 extension and live in California where the unemployment rate is high.They do need to pass the extension as well as a tier 5.There are a lot of honest people out there who need it.

    Great even though the vote yesterday was to break through the fillabuster. The vote to push it isn’t over yet since the Senators are voting on extending it is what I am getting I am getting really confused here the Sens are needing 67 votes for the motion to pass. So there is a vote on whether to allow a republican amendment at this legislative stage for HR 4213 they are needing 67 votes are needed for this motion to pass

It’s not working…I think 42 “yays” is the most I’ve seen and this is the 2nd motion to add on. I just wish they wouls quit and get on with what matters.     I am happy the extension passed. Now, we must continue to seek a new job or figure out what a new business venture. We cannot afford to get caught with our pants down again.
    If we cannot find a job we must make a job.Everyone is great at something. We are all creative and steadfast individuals and we must continue to move forward to secure our own future. I hope the 99,ers will get an extension too.

    I have a question, I lost my first job in sept 2008, then found a job in late february 2009, then was laid off on july 1 2009. I was on tier 1 i believe, however I got my last check on July 10, 2010, in which it said I exhausted my benefits however I may qualify for additional benefits here in California.
    When I called, they said until this bill passes I am done, however if it does pass I will qualify.

    I like most of us am confused and when I asked the EDD lady, she said I am most likely to qualify for the next extension but she can’t say that because she is nt sure when the deadline was for the next tier of extensions….In total I collected 60ish weeks between jobs, I am just scared as I have two kids and cant seem to grasp what the hell they are talking about half the time with 99ers and me being exhausted etc… Thanks for any help….

    2. is there a 30 hour window (beginning after yesterday’s senate passage) that all other signers must sign to make the bill official?

    3. is it true that current signed extension bill must be sent to house of reprseentatives for their signatures and then back to senate for their signatures and then sent to obama for his signature before it becomes final???

    4. can the republicans kill this bill by fillibustering or some other activity that will delay the bill beyond the 30 hour window and thus render the bill dead?

      1. They were trying to add on things to the bill in favor of “their” people (the rich).

      2.The 30 hours is what time was given for the vote to occur. (Which it did in 28 some odd hours)

      3. The Senate voted today on a bill that was slightly different than that of which the House already passed. Therefore, it will go back to the house to be voted on again. The Senate has already approved so after the
      house votes and if they approve, it moves on to the President to be signed into law.

      4.It’s a done deal with Senate….tomorrow it will be voted on in the House.

    QUESTION: I have exhausted my 26 weeks of initial unemployment for IOWA. Does this extension mean I will be eligible for the extension and how long IS the extension? Please, someone- help me out here.

      I am in the same situation in NY. My first 26 weeks ran out a month ago. I have been trying to find out more info.. I just found this on another site, hope it helps :
      New Legislation Would Subsidize More Time To Seek Employment.
      The unemployment benefits extension is a bill that would extend unemployment benefits for unemployed workers who have maxed out their initial 26 weeks of coverage. An estimated 2.5 million people had their benefits cut off within the last month because there was no additional extension system in place—even though jobs are still few and far between. This bill would retroactively reimburse the unemployed their weekly benefits that were cut off while the bill was in limbo and would extend unemployed workers around 99 total weeks of unemployment benefits.

      Make sure that you are still certifying for benefits every week! Ed

      The first tier of the extension is for 20 weeks (5 months). Our benefits would go to late November.

It still needs another vote in the Senate which has to occur within 30 hours of the vote for cloture which is what happened Tuesday, but it is customary for the opposing party to allow a vote before the 30 hours. Then it has to be approved by the House before being referred to Obama for signature into law.

    What I cannot believe is that the Republicans will carry this out to the full 30 hours, which is what they are doing. These Aholes have no idea what an extra day means to many people. I hope they rot in hell. They are very evil people and deserve to be voted out.

    Can someone tell me what has been done today in Congress? I been watching Cspan all day, and it seems that their voting over and over. ON what? Did they get the 51 vote? What is the 67 vote? This is so confusing…

    What happens tomorrow? And why isnt there any news on whats going on?

      Tomorrow it goes to the House to be voted on….it was passed in Senate today around 5:30ish Central.

      The 67 you were seeing needed was to add an amendment (Republicans were trying to add things) and that didn’t happen. They needed 51 votes to pass Senate and it indeed passed 59 “ayes” to 39 “naes”….

    i don’t mean to sound like a jerk, but this country was built on others coming into the country. Now WE americans are at a point where WE are the one’s who are minorities because so many foreign people come here for a better life, which is fine and dandy. But i have been out of work for over a year, and foreigners have jobs, checks and they buy houses. I was born in US, my father fought for this country in 2 wars for what?

    What should be reported is that some states never offered 99 weeks in tier 4 and 86 weeks in tier 3. Each state has it’s own rules even though this is federal money which everyone from every state pays in to from their federal taxes. It is near impossible to tell what one may or may not get. What a pathetic situation, When our so called leaders can’t even get something so simple straight, what on earth are they doing ‘nation building’ elsewhere. Clean up your own house! Lead by example!

    The 99ers have been given their own 911 from congress. A slow financial death is certain effecting millions of family members of the 1 1/2 million denied tier 5. So welfare is the next step. Oh, that cost the government money too? Fasten your seatbelts….going from middle class to poverty will be the ride of your life. Thank you both parties for showing what pompous and unfeeling pigs you really are. There will a citizen revolt of a magnitude that will make the oil spill look like a leaky faucet. If you read this and do nothing to shake up the legislators, hope you find a nice spot under the bridge, and a clean cardboard box.

    Curious for those people who have used there 99 weeks of unemployment, in almost 2 years not 1 employer would hire you? I understand people are used to live a certain lifestyle but there are jobs out there, not the greatest jobs, but jobs that will work till the economy recovers

    I agree that people like myself who have a serious problem with the republican blockage of this vote should stand together in november to vote them out. We our the majority of the nation but too many of us do not vote. I know too many people here in massachusetts who voted for senator Scott Brown for whatever reason that have been in dire need for these benefits. Massachusetts is the most democratic state in the country and Scott Brown has simply voted with his party despite his claim of being independent. Had we all voted with the party that does not cater to the upper class these benefits would not have taken so long to get through congress. Please remember what you’ve went through these last months come november. In the past I have always looked at both candidates in every race but I cannot picture myself ever voting republican for the rest of my life. By the way, Martha Coakley would have put this bill through weeks ago!

    As James said, 2 years is a long time to remain unemployed, although I don’t think you understand many people’s situations. I am nowhere close to being a 99er but I have recently exhausted my original unemployment benefits. People who have had a particular income with house, car and college payments for their children cannot simply take a job at target simply because they are hiring. That would do nothing for their families and because they lost their jobs through no fault of their own, it is rediculous to believe they should take a job a fourth of their previous pay simply because it is there. This simply will not take care of their families. What else are these people supposed to do. I understand there are certainly people out there that abuse the unemployment insurance, but in no way is this close to the majority. I pray that I won’t reach the point that these people are in but I strongly believe that they will accept the first job that can provide for their families in the manner that they need. How do republicans justify the tax breaks they’ve given to big business and the wealthiest percentage of this country and choose to ignore the middle class during a recession.
